Arrest – Burglary, Theft, Distribution of CDS (Heroin) in Newton
On 9/23/14 at 8:11a.m., Newton Police received a report of a burglary to a motor vehicle which was parked at a residence on Cedar Street. The owner of the vehicle reported that a credit card was stolen from the vehicle’s interior. Investigation revealed that the credit card in question was already used at several locations, most recently, the Newton Rite-Aid on Spring Street minutes earlier. As a result, police responded to Rite-Aid and an employee identified the actor using the card as Robert Davis. While police were present at the store, Davis returned and attempted to use the stolen credit card in the ATM machine but it declined his transaction. Davis was taken into custody and the stolen card was retained.
While in custody, Davis also admitted to a previous burglary of a motor vehicle within the Rite Aid parking lot that occurred on 9/22/14 at approximately 9:45 a.m. in which a purse containing a cell-phone was stolen from a customer’s unlocked motor vehicle.
As a result, Robert A. Davis, age 31, of Madison Street, Newton was charged with the following offenses:
N.J.S. 2C:18-2a(1) Burglary (Motor Vehicle) (2 Counts) (3rd Degree)
N.J.S. 2C:20-3a Theft of Moveable Property (Cell-phone) (4th Degree)
N.J.S. 2C:20-3a Theft of Moveable Property (Credit Card) (Disorderly Persons)
N.J.S. 2C:21-6C Theft of Credit Card (4th Degree)
N.J.S. 2C:21-6H Fraudulent Use of Credit Card (3rd Degree)
Bail was set at $29,000 no 10% by Newton Municipal Court Judge John Mulhern for the aforementioned offenses and he was lodged in the Sussex County Jail in default.
Subsequently, Detectives from the Newton Police Department assisted the Sussex County Guns, Gangs and Narcotics Task Force with the arrest of Davis for other unrelated offenses which included the following:

N.J.S.2C:35-7 Distribution of CDS (Heroin) within 1000 feet of a school (3rd Degree)
N.J.S. 2C:35-7.1 Distribution of CDS (Heroin) within 500 feet of a public park (2nd Degree)
Additional bail set by Judge Mulhern for these charges at $110,000 no 10%.
A co-defendant of Davis’, identified as Elaine Affronte, age 32, of Trinity Street, Newton was also arrested by the Sussex Count Guns, Gangs and Narcotics Task Force for the below listed charges:

N.J.S. 2C:24-4a Endangering the Welfare of a Child (2 Counts) (2nd Degree)
She was lodged in the Sussex County Jail in default of $100,000 no 10% bail.
