On My Mind…What Do You Think Will Happen In the Case of “Justifiable Need?”
So, I’d written previously about two weeks ago regarding John Drake’s case…at this point, the decision has now been deferred twice and today is supposed to be the day…
What is the court going to decide on this? I don’t have an answer even in my own head yet, I’m thinking negatively since this has been postponed twice now and I hope I’m wrong. The court is supposed to decide today or Monday at the very latest. I think it’s going to create a real stir if John is not given the chance to carry.
Many people had passed my initial post around and some said that there should be no justifiable need clause period that our forefathers created the Second Amendment intelligently to allow for this right, without anything else impeding it. Another person argued it was created with the interests of militia in mind at that time, which caused a debate in itself between a few parties, including me (one arguing that the people had no rights and two stating they do). That’s like saying we need to toss out the Declaration of Independence and The Bible, because they were not written today. These writings in the documents I’ve mentioned and The Bible were meant to be enduring. The forefathers designed the Constitution with the present and future in mind…not just their generation. They were thinking of you and me and those in generations way beyond us.
This is the version passed by Congress in our National Archives:
“A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
Many wish to sweep the second clause under the rug, “the right of the people to keep and bear Arms, shall not be infringed,” as if it never existed and say it only applies to militia…it applies to both militia and individuals…
