Driving While Intoxicated/Allowing Intoxicated Driver to Drive
On 6-18-14, the Byram Twp. Police Department responded to a report of a hit-and-run motor vehicle accident on Cranberry Ledge Road. Patrols found the suspect vehicle, which was disabled on the street. During the investigation, it was determined that James J. Smith of Phillipsburg was driving the vehicle. Smith was arrested for Driving While Intoxicated. The vehicle owner, James N. Stabile of Byram Twp. was then given a summons for Allowing an Intoxicated Driver to Drive. Stabile was released pending a mandatory Byram Twp. Municipal Court date. Smith was transported to the station where he failed several field sobriety tests and refused to submit to breath testing. Smith was issued the following summonses and lodged in the Sussex County Jail due to an outstanding child support warrant: Driving While Intoxicated, Refusal to Submit to Breath Tests, Driving While Suspended, Reckless Driving and Possessing a Suspended Driver’s License.
